These Terms apply to consumers and business customers.
A consumer is a natural person purchasing mainly for purposes outside their trade, business or profession.
A business customer is a person or entity acting for purposes connected with their trade, business or profession.
The contract language is English.
2. Products and condition
thee76s sells new, pre owned, vintage and collectible fashion products.
Each item is individually inspected before it is listed and shipped.
Product photographs, condition descriptions, measurements, included accessories and any visible signs of wear form part of the product description.
Pre owned and vintage items may show signs of age, use, fading, repairs, marks, wear or other characteristics consistent with their condition and age.
Minor differences in colour may occur because of lighting conditions, photography or individual screen settings.
Where measurements are provided, they are approximate.
3. Contract formation
Product listings on thee76s.com do not constitute a binding offer to sell.
By completing checkout, you submit a binding offer to purchase the selected item or items.
The automated order confirmation only confirms that we have received your order. It does not constitute acceptance of the order.
A purchase contract is concluded when we send a separate dispatch confirmation or dispatch the ordered item.
We may reject an order before acceptance if an item is unavailable, incorrectly priced, affected by an obvious listing error, subject to suspected fraud, cannot be shipped legally or cannot reasonably be fulfilled.
If payment has already been received for an order that cannot be accepted, the payment will be refunded using the original payment method where possible.
4. Prices and payment
All prices shown on thee76s.com are final prices.
Where applicable, VAT is not separately shown in accordance with Section 19 UStG.
Shipping costs and available payment methods are displayed during checkout before you place your order.
Payment must be completed using a payment method available during checkout.
Products remain the property of thee76s until full payment has been received.
5. Shipping and delivery
Shipping, delivery times, tracking information, customs matters and import charges are governed by our Shipping Policy.
For deliveries outside the European Union, customs duties, import taxes, carrier charges or local handling fees may apply.
Unless stated otherwise during checkout, these charges are the responsibility of the recipient.
For consumers, the risk of accidental loss or damage passes when the item is delivered to the consumer or a person named by the consumer.
For business customers, the risk passes when the item is handed to the carrier.
6. Right of withdrawal and returns
Consumer rights of withdrawal, returns and refunds are governed by our Returns and Refunds Policy.
Nothing in these Terms limits or excludes mandatory consumer rights.
Business to business purchases are final unless otherwise agreed in writing before payment.
7. Product issues and statutory rights
Your statutory rights remain unaffected if an item is materially not as described, defective or otherwise subject to mandatory legal rights.
Condition details, visible wear, measurements, repairs, signs of age or characteristics clearly shown in photographs or stated in the product description do not constitute a defect.
If you believe that an item is materially not as described, damaged on arrival or not authentic, contact us as soon as possible at thee76sbusiness@gmail.com.
Please include your order number, clear photographs and all relevant information.
Do not wear, alter, clean, repair or resell the item while the matter is being reviewed.
8. Authenticity and trademarks
thee76s is an independent reseller.
All product names, logos, trademarks and brand names displayed on this website belong to their respective owners and are used solely to identify and describe the products offered.
thee76s is not affiliated with, endorsed by or authorised by any of the brands displayed or mentioned on this website.
9. Use of the website
You may use this website only for lawful purposes.
You must not interfere with the security, operation or availability of the website.
You must not use automated systems, software or methods to scrape, copy, access or collect information from the website without our written permission.
10. Website availability
We aim to keep thee76s.com available and accurate at all times.
However, we do not guarantee uninterrupted access to the website, including during maintenance, technical problems, updates or events outside our control.
This does not affect accepted orders or mandatory statutory rights.
11. Applicable law and jurisdiction
German law applies to purchases made through thee76s.
